1. Use of personal data

1.1.1. Wudae asks you for personal data when:

• (a) you enter into an agreement with Wudae;
• (b) you, as a parent, guardian or legal representative, co-sign the agreement;
• (c) your IBAN is used with a different account holder name.

1.1.2. When you visit www.wudae.com, Wudae may ask you for personal data if you:

• (a) contact us via the contact form;
• (b) use/complete the free trial-class form;
• (c) use Wudae’s contact details.

1.2.1. Wudae may collect the following (personal) data when you visit www.wudae.com:

• (a) name (first and/or last name);
• (b) email address;
• (c) IP address;
• (d) text of your message;
• (e) preferred trial-class date;
• (f) phone number;
• (g) year of birth;
• (h) comments / questions;
• (i) language preference.

1.2.2. Wudae may collect the following (personal) data when you enter into an agreement with Wudae:

• (a) first name;
• (b) last name;
• (c) phone number;
• (d) email address;
• (e) parent;
• (f) guardian;
• (g) legal representative;
• (h) different account holder name for direct debit;
• (i) signature;
• (j) gender;
• (k) date of birth;
• (l) nationality;
• (m) occupation;
• (n) street + house number;
• (o) postcode + city;
• (p) IBAN;
• (q) BIC;
• (r) place of birth.

1.3. Wudae may use these data to:

• (a) contact or stay in touch with you;
• (b) answer questions;
• (c) confirm the trial class and inform you about it;
• (d) communicate in the correct language;
• (e) enter into and perform agreements;
• (f) keep the membership administration;
• (g) social media;
• (i) enforce disciplinary rules;
• (j) carry out other activities customary for a gym;
• (k) prepare, send and collect invoices, enrolment fees and/or tuition fees.

1.4. The grounds on which Wudae may collect your personal data are that:

• (a) processing is necessary for the performance of an agreement to which you are a party;
• (b) you have given consent for processing your personal data for the purposes set by Wudae;
• (c) processing is necessary to comply with a legal obligation to which the controller is subject;
• (d) processing is necessary for the legitimate interests of the controller or a third party, except where those interests are overridden by your interests or fundamental rights and freedoms requiring protection of personal data, in particular where you are under 18;
• (e) as a visitor to www.wudae.com you give consent by agreeing to the privacy statement.

1.5. In addition, Wudae collects information about:

• (a) your visit to Wudae’s website. This primarily concerns data your browser sends by default to every website you visit, such as your IP address;
• (b) your social media expressions related to Wudae, and contact you make with Wudae via social media.

1.6. Providing your personal data is not mandatory. If you do not provide your personal data to Wudae, this may mean that Wudae cannot fulfil the points mentioned in 1.3, among other things.

2. Use of cookies and visitor registration

2.1. What are cookies? Wudae uses cookies, small text files stored on your computer or mobile device when you visit our website. These cookies contain information used to improve your experience, personalise our advertisements, and analyse our website traffic.

2.2. Types of cookies Wudae uses:

• (a) Necessary cookies: essential for the technical operation of our website and to enable you to use website functions.
• (b) Analytical cookies: allow us to analyse and optimise use of our website and help us understand how visitors interact with it.
• (c) Marketing cookies: used to personalise advertisements and offer you relevant content. These cookies may be placed by Wudae or by our partners.

2.3. Third-party cookies. Wudae uses cookies placed by our partners, such as Google and Meta. These partners help us analyse visitor behaviour and optimise advertisements, enabling us to improve our services and your experience. Data collected via these cookies may be used by our partners for their own purposes. The list of partners may change. For the most current information, please contact us.

2.4. Your consent and cookie management. For cookies that are not strictly necessary for the website to function, we ask for your consent on your first visit. This is done via a cookie banner that lets you accept all cookies or manage your preferences. You can change your cookie settings at any time via your browser settings or the cookie settings on our website.

2.5. How can you manage cookies? You can manage and delete cookies via your internet browser settings. You can also adjust your cookie preferences at any time via the cookie notice on our website. 3. Rights regarding your personal data

3.1. The personal data Wudae has collected from you are yours personally. You therefore have the following rights:

• (a) The right to withdraw your consent. You may withdraw consent you gave for use of your personal data. From that moment, Wudae may no longer use your personal data without another legal ground. Until you withdraw consent, Wudae was allowed to use your personal data.
• (b) The right of access. On request, Wudae will tell you whether anything has been done with your personal data and, if so, what. Wudae will inform you about the purposes for which your data were used, which data were used, and who the recipients are or will be. Where possible, Wudae will also tell you for how long your data will be stored or on what basis that period is determined.
• (c) Right to rectification. If your personal data are incorrect or incomplete, contact Wudae. Wudae will correct or complete them as soon as possible and will also inform recipients of your personal data.
• (d) Right to erasure of your personal data. On request, Wudae will erase your personal data as soon as possible, subject to only a few exceptions. When Wudae no longer needs your data for the purposes described above, or if Wudae processed or obtained them unlawfully, Wudae will delete them and inform recipients.
• (e) Right to restriction of processing. In a number of situations you have the right to restrict processing of your personal data. To exercise this right, contact Wudae. Wudae will also inform recipients.
• (f) Right to lodge a complaint. As a data subject you have the right to lodge a complaint with the supervisory authority. This can be done with the Autoriteit Persoonsgegevens (AP), among other things via https://autoriteitpersoonsgegevens.nl/

3.2. To verify that the request was made by you, Wudae asks you to include a copy of your identity document with the request. On that copy, black out your passport photo, MRZ (machine readable zone, the number strip at the bottom of the passport), passport number and Burgerservicenummer (BSN). This is to protect your privacy. Wudae responds as soon as possible, and no later than within four weeks.

4. Privacy policy of other websites

4.1. www.wudae.com contains links to other websites. Wudae is not responsible for the privacy policy of those websites if they are not Wudae’s own. For more information, Wudae refers you to the websites concerned.

5. Third parties

5.1. Wudae will not provide your data to third parties unless you have given express consent or Wudae is required to do so by law or a court order.

5.2. If Wudae uses a party that processes your personal data for Wudae, for example a party for collecting overdue payments, Wudae concludes a data processing agreement with that party.

5.3. Parties outside the European Union with which Wudae cooperates are required to treat your personal data in a manner comparable to the General Data Protection Regulation. This includes the EU-US Privacy Shield. The EU-US Privacy Shield is an agreement on the protection of personal data of EU citizens processed in the United States.

6. Personal data of website visitors under 18

6.1. Wudae’s website and/or service does not intend to collect data about website visitors under 18, unless they have parental or guardian consent. Wudae cannot, however, verify whether a visitor is over 18. Wudae therefore advises parents to be involved in their children’s online activities to help prevent data about children being collected without parental consent. If you believe Wudae has collected personal data about a minor without that consent, please contact Wudae. Wudae will then delete that information.

7. Securing personal data

7.1. Wudae takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorised access, unwanted disclosure and unauthorised alteration.

7.2. To meet these obligations as well as possible, Wudae secures your personal data using the following technical measures:

• (a) Secure Socket Layer (SSL);
• (b) HTTPS;
• (c) FTPS;
• (d) encryption of digital files (XTS-AES-128 encryption with a 256-bit key);
• (e) Wordfence Alert;
• (f) username to log in;
• (g) 2FA;
• (h) password to log in to Wudae’s systems.

7.3. If you believe your data are not properly secured or there are indications of misuse, please contact Wudae.

8. Notification to the Autoriteit Persoonsgegevens

8.1. If, despite the security measures taken by Wudae, a security breach occurs that leads to (a risk of) significantly serious adverse consequences for the protection of your personal data, the Autoriteit Persoonsgegevens will be notified.

9. Notification to the data subject

9.1. You will be informed of a possible security breach at Wudae if the breach is likely to have unfavourable consequences for your personal life.

10. Retention period for personal data

10.1. Wudae does not retain your personal data longer than strictly necessary to achieve the purposes for which your data are collected, or as required by law.

10.2. If you have an agreement with Wudae, Wudae retains your data at least for the term of the agreement and for the duration of the statutory tax retention obligation.

11. Changes to the privacy statement

11.1. Wudae closely monitors new privacy laws or amendments to current privacy laws so that the privacy of natural and legal persons can also be safeguarded in the future.

11.2. Wudae reserves the right to amend the policy set out in this privacy statement in the future. Wudae therefore advises you to review Wudae’s privacy statement regularly.
